Welcome to TallTale (“TallTale”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of the TallTale website, platform, and related services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian.

By using the Service, you represent and warrant that you meet these requirements.

2. Accounts

Certain features of the Service require an account.

You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity occurring under your account.
• Providing accurate and current account information.

You agree not to share your account with others or allow unauthorized access to your account.

3. Subscriptions and Payments

Some features of the Service may require a paid subscription.

By purchasing a subscription, you agree to pay all applicable fees.

Unless otherwise stated:

• Subscription fees are billed in advance.
• Fees are non-refundable except where required by law.
• We may change pricing in the future with reasonable notice.

Failure to pay applicable fees may result in suspension or termination of access to premium features.

4. User Content

Users may create, upload, display, transmit, or share content through the Service, including but not limited to:

• Maps
• Images
• Tokens
• Text
• Character information
• Campaign notes
• Drawings
• Chat messages

You retain ownership of any content you create or upload.

By uploading or sharing content through the Service, you grant TallTale a non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display that content solely as necessary to operate and improve the Service.

You are solely responsible for your content and the consequences of sharing it.

5. Prohibited Conduct

You agree not to:

• Violate any applicable laws or regulations.
• Infringe the intellectual property rights of others.
• Upload malicious code, malware, viruses, or harmful software.
• Attempt to gain unauthorized access to the Service or its systems.
• Disrupt, interfere with, or degrade the Service.
• Harass, threaten, abuse, or impersonate others.
• Use the Service for unlawful, fraudulent, or harmful purposes.
• Upload content that is illegal, defamatory, or otherwise unlawful.

We reserve the right to remove content or suspend accounts that violate these Terms.

6. Intellectual Property

The Service, including its software, design, branding, graphics, animations, text, and other proprietary materials, is owned by TallTale or its licensors and is protected by applicable intellectual property laws.

These Terms do not grant you ownership of any TallTale intellectual property.

You may not copy, modify, distribute, reverse engineer, or create derivative works of the Service except as permitted by law.

7. Availability

We strive to provide a reliable service but do not guarantee uninterrupted availability.

The Service may occasionally experience:

• Maintenance periods
• Service interruptions
• Software bugs
• Technical failures
• Third-party outages

We may modify, suspend, or discontinue any portion of the Service at any time.

8. Account Suspension and Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms.
• Engage in abusive behaviour.
• Present security risks.
• Harm other users or the Service.

You may stop using the Service at any time.

Upon termination, access to your account and stored content may be removed.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TALLTALE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TALLTALE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO TALLTALE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless TallTale, its owner, affiliates, and service providers from any claims, damages, liabilities, costs, or expenses arising from:

• Your use of the Service.
• Your content.
• Your violation of these Terms.
• Your violation of any rights of another person or entity.

12. Privacy

Your use of the Service is also governed by our Privacy Policy.

By using the Service, you acknowledge that we may collect and process information as described in the Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time.

Updated versions will be posted on this page with a revised “Last Updated” date.

Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.

By using TallTale, you acknowledge that you have read, understood, and agreed to these Terms of Service.
